Добрый день. Сегодня 10 ноября 2010 года, я получил извещение из почтового отделения о том, что мне пришла посылка под № CP501711592US из USA. Я пошел на почту, и, зная о том, что продавец имеет негативный рейтинг и уже обманывал покупателей, попросил открыть посылку в присутствии работника почтового отделения.
Контрольное взвешивание посылки показало, что она весит 600 грамм. По запросу работника почтового отделения была получена информация о том, что вес посылки поступившей в Российскую Федерацию тоже составляет 600 грамм (это можно посмотреть на сайте почты России). Т.е. посылка никем не вскрывалась и посторонних вложений или изъятий сделано не было.
При вскрытии посылки было обнаружено:
1. Махровые салфетки – 2 штуки;
2. Шорты – 1 штука;
3. Коробка от телефона Iphone 3GS;
4. Картонная упаковка самой посылки.
Телефона Iphone 4, который должен был выслать продавец, коробки от телефона Iphone 4 и аксессуаров к нему в посылке не было.
Я был очень разочарован обманом.
Когда я оплатил товар 18 октября 2010 года, он обещал мне закрыть свой лот с данным телефоном на eBay. Но не сделал этого. На мой вопрос почему – он ответил, что не может этого сделать, т.к. если осталось до конца лота менее 18 часов сделать это невозможно. И как только закончиться лот он отменит сделку с покупателем. Я не поверил ему и выиграл лот 250712537856, чтобы обезопасить себя. Зайдя на описание лота через день, я с удивлением обнаружил, что лот был выставлен заново. Получается, что продавец продал один и тот же телефон два раза. На мой вопрос, почему он так сделал, продавец ответил, что у него имеется два телефона, хотя в описании лота был указан только один. И я сомневаюсь, что у него было два абсолютно одинаковых телефона и два одинаковых комплекта аксессуаров. После оплаты товара продавец пропал. После того, как я стал писать ему, он начал отвечать, что скоро отправит товар, чтобы я не волновался и что все будет хорошо. Я потерял надежду и попросил его вернуть мне деньги. Он написал, что выслал посылку и дал номер отправления – LC589029050US. Это был поддельный номер. Прошло 1,5 недели после оплаты товара и, только после открытия претензии на Paypal , продавец выслал посылку, но уже с другим номером отслеживания CP501711592US. Он сказал, чтобы я закрыл претензию, так как в противном случае он напишет в Paypal и претензию решат в его пользу. Я закрыл претензию как он сказал.
Еще меня насторожил тот факт, что при обсуждении товара он написал, что на телефоне стоит прошивка 4.1. Когда я сказал, что такой телефон мне не нужен, он сказал что версия модема у него старая. Хотя такое невозможно, т.к. при официальной замене прошивки версия модема поднимается. А на вопрос о том стоит ли у него Cydia – он не ответил. Он не отвечал на многие уточняющие вопросы, но я не придал этому значения. Хотя это уже говорило о том, что продавец хочет меня обмануть. Также на фотографиях, которые он мне выслал видна коробка Primary Mail International другого размера. Видимо он сфотографировал коробку в которой отправил телефон по второму лоту.

Как думаете - шансы есть отстоять себя?

Hello again, all the package sending by the Primary Mail Int have a tracking (you can check it go to usps.com and put CJ206801623US - last item i get from USA). May be is cost a little more but tracking is very important because it may be stolen or damage on the post.

You have Cydia installed? It will be nice if you can downgrade iOS to 4.0 but you can`t downgrade modem version. There is no unlock for the modem is 4.1. (unlock have only modem firmware 01.59.00)

У нас был вообще прикол.

Живут два человека в одной съемной квартире. Оба хотели сноуборд купить. Ну я им обоим дал ссылку на нормального продавца.

Два друга не зависимо друг от друга заказали...
Первый: Доску и крепления для доски
Второй: Крепление.

В итоге продавце решил что они вместе и отправил доску без креплений, а две пары креплений на адрес Первого.

Вдобавок выслал Приорити, а не ЕМС. За его косяки стресли 40 бакосов рефанд.

А вам удачи. Пишите в суппорт, пейпал и т.д. Авось повезет.

Диспут наверное как раз можно открыть. Т.к. первый я открывал по неполучению. Второй можно по не соответсвию. На крайний случай еБай протектион.
Просто интересно как и где лучше открывать - в палке или на ебее. Сейчас вроде русский ебай открыли, может полояльнее будут? Плюс на русском языке.
Кстати может поможете с корректировкой перевода претензии?

Good afternoon. Today on November, 10th, 2010, I have received the notice from post office that to me the parcel under № CP501711592US from USA has come. I have gone on mail, and, knowing that the seller has a some negative feedbacks and already deceived buyers, have asked to open a parcel in the presence of the worker of post office.
Control weighing of a parcel has shown that it weighs 600 gramme. On demand of the worker of post office the information that the weight of a parcel arrived to the Russian Federation too makes 600 gramme (it has been received it is possible to look on a site of Russian Post). I.e. the parcel was opened with nobody also extraneous investments or withdrawals has not been made.
At parcel opening it was revealed:
1. Terry napkins - 2 pieces;
2. Shorts - 1 piece;
3. The Box from phone Iphone 3GS;
4. Cardboard packing of the parcel.
Phone Iphone 4 which the seller should send, boxes from phone Iphone 4 and accessories to it in a parcel were not.
I have been very disappointed by a deceit.
When I have paid the goods on October, 18th, 2010, he promised to me to close the auction with given phone on eBay. But has not made it. Why - he has answered my question that cannot make it since if remains till the end of a auction less than 18 hours to make it it is impossible. And as soon as to end a auction he will cancel the transaction with the another buyer. I have not believed to it and have won a auction 250712537856 to secure myself. When i look at this eBay auction next day, I with surprise have found out that the item has been re-listed. It turns out that the seller has sold the same phone two times. The seller has answered my question why he so has made, that he have two phones but in the auction description one has been specified only. And I doubt that at it was absolutely identical two phones and two identical complete sets of accessories. After payment of the item the seller was gone. After I began to write him, he has started to answer that he will send the phone very soon that I did not worry and that all will be good. I have lost hope and have asked it to return me money. He has written that has sent a parcel and has given tracking number - LC589029050US. It was counterfeit number. Has passed 1,5 weeks after payment was made and, only after claim opening on Paypal, the seller has sent a parcel, but already with other tracking number CP501711592US. He has told, that I must close the claim, otherwise he will write in Paypal and the claim will solve in its advantage. I have closed the claim as he has told.
I was wary with that fact that at discussion of the iPhone4 he has written that on phone 4.1. iOS is installed. When I have told that such phone is not necessary to me, he has told that the version of the modem at it old. But it is impossible, because when you update iOS modem firmware rises too. On my questions about Cydia - he has not answered. He did not answer many specifying questions, but I have not given it value. Though it already said that the seller wishes me to deceive. Also in photos which he has sent me Primary Mail International box is other size of the box that have come. Probably he has photographed a box in which has sent phone on the re-listed item.
I ask to examine the given claim and to oblige the seller to return the stolen money.

Попробуйте узнать в своем банке про chargeback, если других вариантов не останется.

Карточка сбера, сам там работаю, поэтому поднял на уши весь отдел банковских карт. К сожалению чарджбэк сделать невозможно, т.к. Списание средств уже было. Также нельзя получить возмещение от банка в моем случае, т.к. Товар был доставлен.

Подскажите где лучше претензию открывать - в палке или ебае? Одновременно нельзя т.к. Был опыт когда палка закрыла диспут из за того что по этому товару был открыт на ебае

Начал общаться с продавцом. Он якобы удивился. Я ему говорю - иди и получай страховку. Он говорит что страховку можно получить если я отошлю все обратно:
Ok. I actually just got off the phone with them. They said what needs to happen is:

1. You ship the package back to my address, with the articles in the box inside.
2. Once they receive the package they will open an investigation into what happened in regards to the package.
3. Once a decision is made upon the investigation (they said it will most definitely be decided in your favor), they will send a refund check to the address I provide them with for you.

Я ему говорю что разбирайся с почтой сам. Я вышлю тебе все. А дальше твои проблемы. Он мне отвечает

So you want me to refund your money before the insurance kicks in? I will be unable to do that. I will gladly refund you your money when I get the package back in the mail and confirm with the post office that I will get my money back through them. When I get my money back through the post office I will gladly refund you.

У вас в сбере как обычно бардак и полный профанизм! На форуме есть тема как осуществить чарджбек именно для сбера. Мне кажется все условия мошенничества налицо.

Диспут наверное как раз можно открыть. Т.к. первый я открывал по неполучению. Второй можно по не соответсвию. На крайний случай еБай протектион.
Просто интересно как и где лучше открывать - в палке или на ебее. Сейчас вроде русский ебай открыли, может полояльнее будут?

Вы сильно заблуждаетесь. Нельзя диспут открыть второй раз. Имея защиту от paypal и ebay вы можете претендовать только на одну из этих защит. И только по одному поводу, по недоставке и по несоответствию. И если вы уже открывали диспут на paypal - то на ebay открыть не сможете.

Продавец грамотно провел мошенническую схему. Он сделал все, что бы вы не смогли забрать у него деньги. И в вашем случае есть только один выход, идти в банк и писать на чарджбэк, предоставляя все доказательства. Других шансов вернуть деньги у вас нет.

Не совсем в тему у меня Iphone 4прошивка 4.1 а модем старый, так что по-этому вопросу Вас могли и не обмануть. Можно поднять прошивку до 4.1 из 4.02 не меняя версию модема. Но в Вашем случае это не поможет.

У меня интереная ситуация. Получается что мы с продавцом договаривались о продаже телефона минуя ебай. Я оплатил по инвойсу 18 октября. А 19-го видя что продавец не заканчивает лот, купил его. Т.е. Еще один шанс у меня на претензию есть.
А в банке будет отказ. Банк выполняет обязательства по переводы денег. И не отвечает за продавцов, хотя может тупо написать что вещь не проучена?
Прижал продавца - он сказал чтобы я высылал все обратно и он сделает рефунд. Не верю я ему конечно. Сегодня попробую кейз открыть. Кстати в палке же есть возможность открыть второй кейз по несоответсвию товара.

Ошибся - второй кейз не дает открыть ((( написал в скупого палки и на русский ебай.

Сегодня после длительной переписки с продавцом и в итоге перевода в кейз пришло письмо от ебая.
