Продавец из Англии jambridge хочет кинуть !?

До покупки колонок в Англии, связался с продавцом, чтобы узнать, сможет ли он занизить таможенную стоимость.
Продавец согласился.
Купил колонки. Оплатил PayPal с VISA.
Стоимость колонок - 145 GBP. Пересылка - 135 GBP.
Написал ему ограничение по суммам если отправлять транспортной компанией и почтой.
Он отправил их FEDEX-ом.
Их задержали на российской таможне и отправили назад.
Спрашиваю у продавца: почему не пропустила таможня - отвечает "маленькая таможенная стоимость".
Звоню в FEDEX в Москву.
Спрашиваю, во сколько была оценена посылка ?
Ответ - 1 GBP !!!

Однако продавец обвиняет меня, т.к. он указал заниженную стоимость по моей просьбе. (но я то не говорил ему, что нужно указать 1 GBP. я сообщил ему максимальные суммы оценки )
И может их отправить ещё раз, если я ему оплачу стоимость пересылки.

Непонятен вес посылки. (посылка одна)
Вес каждой колонки реально около 12 кг.

Он пишет в письме, что каждая будет весить 35 кг.
Затем в лейбле FEDEX указан вес 12 кг (за обе колонки)
На фото от продавца, после возврата колонок, на коробке написано 20 кг.

Я открыл диспут, где мы мирно все указали и перевел его в клейм. (первый раз. до этого не приходилось)
Недавно клейм начали рассматривать и сегодня я получил от продавца письма - какую-то пургу насчет ботинок.
Вроде как я ему вернул вместо колонок ботинки.
Так я не видел даже в глаза эту посылку.
Её задержали на таможне и отправили назад.

Похоже продавец что - то придумал и решил навесить лапши на уши PayPal.
К сожалению я не знаю языка и не могу звонить в PayPal.
Стоит ли мне предпринимать какие - либо шаги или пустить все самотеком, надеясь, что в PayPal разберутся кто есть кто ?
Силы не равны. У него уже 1467 (99,6% ) отзывов,а у меня 121 (98,6% )

Shipping is either with DHL or FedEx and includes tracking and insurance.
If you wish to arrange your own shipping you are most welcome,
the speakers will weigh c35 kilos each when packed and I will charge ?10 for packing including fresh bubble wrap,
cardboard and 'double boxing'.

Hi Sergey and many thanks for your payment. I can certainly do you an
invoice for '2 second hand loudspeakers, ?50.00' if you like, but if they
are lost in transit or a problem occurs (which I don't expect) then you
cannot claim the insurance for the full value. I hope to send them to you
tomorrow, Tuesday, so please can you let me know exactly what you would like
me to put on the invoice for you? I don't normally include the shipping cost
in any case.

I have heard from FedEx that there is a problem with your parcel
as the customs claim that I have put too low a value on the speakers.
I have explained that the value was entirely accurate as the speakers are some 20 plus years old
and at the moment I am waiting to hear further from them. I am writing just to keep you informed of all developments.

I followed your instructions exactly.
The speakers are being held by Russian customs.
I am waiting to see if they are delivered or returned.
I have asked FedEx to submit them to the Russian customs for clearance. As soon as I know any news, I will tell you.

Hi, I am also not happy about the situation, I have just waited here for a
whole day as Fedex were meant to deliver them back to me to-day and now this
will not happen until Monday, when I am expected to wait all day in the hope
that they will arrive. I followed your instructions absolutely and it
appears that the problem lies with those instructions. I hope that the
speakers will arrive back safely and will check them over when they get
here. This is a great problem to me and taking a great deal of my time and
the situation is not one that I have made. Please be patient whilst I try
and sort things out for you.

Hi Vitaly, I am a little surprised at your email as you have not sent any further funds for the postage.
I told you that the speakers were returned on Tuesday (I was away yesterday).
They were apparently rejected by Russian customs because of the valuation that you placed on them.
If you wish me to either send them as 2 separate parcels or to an alternative address or with the full price on them,
please let me know and I will get a quote for you. I must remind you that I told you at the outset that the responsibility
for the valuation would be yours and your acknowledged that in your email to me.

Hi, if you check your email when you first asked me to undertake shipping
with a false invoice for you, I told you of the risks and you accepted. I
told you that I was using FedEx and you did not raise any objection, you
only mentioned Royal Mail after the item was held in Russian customs. You
own the speakers which you have paid for, they are yours no problem. The
shipping was at your risk and at least the speakers have been returned
undamaged, due to my very good packing. I can certainly try to send them
again, but you will have to pay for the postage. I can send them to 2
addresses or I can send them to one address, I can use your valuation or a
true one, the decision is yours. However I must remind you that you
instigated this and the responsibility for the rejection by Russian Customs
a problem of your making. I want to help you, but if you look at all of the
very many emails that have passed between us, you will see that I am
correct.

thank you for the box of shoes. Unfortunately the box broke open in transit
(it was very badly packed) and Fedex noted the contents (shoes not loudspeakers) and re packed it for you.
I don't know why you would send me shoes and then label the box 'Loudspeakers',
but as it broke open in transit, your mistake is now obvious to everyone.
You should also note that the size of the box was far too small to contain the loudspeakers!!

Why did you send me a box of shoes??!! The box was broken in transit, Fedex had to re-pack it for you!!
Fedex saw that the contents was not loudspeakers, but shoes!! I can send you and PayPal the photos if you would like me to.

I should add, that the shoes are very nice, but they are for ladies and not in my size!
If you wish to send me some shoes, I am male and my size is 10 1/2.

Vitaliyi, I already told you, the speakers came back some weeks ago!!
I told PayPal that as well. This parcel of shoes is very kind of you,
but I really can't wear them as they are too small.
The parcel that you have just sent to me is also far too small to contain the speakers that I sent to you.
You did not pack the parcel well and it broke open in transit.
Fedex have examined it in Germany and also in France and made a note of the contents of the parcel,
which did not correspond with the description that you provided.
I am very happy to send your loudspeakers to you, I always have been.
The problem is the customs declaration that you asked me to make, which the Russsian customs did not believe.
If you would like to send me the funds to return the speakers to you, I will be delighted to do so!!

Оставьте как есть, но Вы обязаны ответить на вопросы, если Вас просят. Иначе ничего не вернут.
У него нет никаких убытков - за возврат он не платил, товар вернулся. Вы не получали посылку, Вашей подписи нет, в базе FedEx слов Final Delivery тоже нет. За декларирование отвечает отправитель.
Думаю, он просто на дурачка. Напишите, что в таких обстоятельствах он был обязан сам сделать рефанд, а не доводить до клэйма.

С начала клейма прошло уже 32 дня. PayPal молчит.
Сколько это может ещё продолжаться ?
